Receipt of a permit for attracting foreign labor

Reception and consideration services provided by the Migration Service are free of charge.

Consultations on the issues of attracting foreign labor are carried out by the employees of the department of the Service for working with foreign citizens (phone number: 0312 301117).

A fee fixed by the Government of the Kyrgyz Republic is charged for the issuance of permits (Resolution of the Government of the Kyrgyz Republic dated October 31, 2006 No. 754).

Reception and consideration services provided by the Migration Service are free of charge.

The Guidance Note on the Submission of Documents for Obtaining a Permit to Engage Foreign Labor Workforce in Electronic Form.

 

  1. General Provisions

 

1.1. This document was developed to implement Order of the State Migration Service under the Government of the Kyrgyz Republic dated January 25, 2018 No. 21-ni, which provides for the possibility of submitting documents to the State Migration Service under the Government of the Kyrgyz Republic (hereinafter referred to as “SMS”) in electronic form by using e-mail.

1.2. This document specifies the procedure for preparing and sending documents in electronic form to e-mail of the SMS for registration of work permits for foreign citizens on the territory of the Kyrgyz Republic, as well as regulates the procedure for feedback between them.

1.3. In order to ensure compliance with the basic requirements imposed by legislation on electronic documents, the relations between the Applicants and the SMS will be based on the use of electronic digital signature (EDS). The use of EDS allows regulating and establishing the rights, duties and responsibilities of participants of legal relations arising in the sphere of electronic document management.

 

 

Note: EDS is issued by organizations that issue certificates of electronic signature verification keys for use in public information systems in accordance with the Law of the Kyrgyz Republic “On Electronic Digital Signature” and are accredited certification centers.

  1. Preparation of documents for their submission for consideration in electronic form

2.1. Documents are sent to the SMS through any e-mail service (mail.ru, yandex.ru, gmail.com, yahoo.com, etc.) and through the use of corporate e-mail services.

2.2. For submission of documents in electronic form, documents must be converted into electronic form by means of scan tools (electronic documents in the form of files with images of documents scanned from paper carriers).

2.3. All documents must be scanned in PDF format, which ensures the preservation of all authentic features, namely: the graphic signature of a person, the seal, the corner stamp of the form, the reference number and the date of the application, etc.

2.4. Each separate document must be scanned and uploaded to the document filing system as a separate file (documents containing several sheets are scanned in one file).

2.5. The number of files should correspond to the number of documents submitted for review, and the file name should allow to identify the document and the number of pages in the document (for example: Labor contract.3 sheets.pdf).

2.6. The images of documents is to be scanned while ensuring the preservation of all authentic features, namely: the graphic signature of a person, the seal, the corner stamp of the form, the reference number and the date of the application, etc.

2.7. In accordance with the Order of the SMS, the scanned versions of the following documents are sent for consideration:

  1. a) Documents for obtaining a permit to attract and use foreign labor workforce (FLW):
  • Application for attracting and using FLW on the prescribed form;
  • State Registration Certificate (notarized copy);
  • License to carry out activities with relevant annexes (in the case of licensed activities);

 

 

 

  1. b) Documents for obtaining a work permit (personal cards):
  • Application with the questionnaire data of a foreign employee on the prescribed form;
  • Notarized translation of a copy of the passport of a foreign citizen with a valid visa (category I, W1) or registration;
  • Copy of the Diploma (notarized translation) of Education (in the sphere of education, medicine, pharmaceuticals and jurisprudence);
  • International Medical Certificate of HIV-Infection Blood Test (Republican AIDS Center, Bishkek, Logvinenko str. 8, crosses Bokonbaeva str.);
  • Colored matte photos with a corner on a white background (size 3×4, JPEG format (300 dpi)) – 1 pc.;

2.8. Files with the images scanned from the paper carrier sent for consideration shall be signed with the electronic digital signature (EDS) of the Applicant, and encrypted with the public key of the SMS posted on the official website of the agency www.ssm.gov.kg. The specified files signed with the EDS are packed into an archive file (hereinafter – Transport Container).

2.9. The created files are sent to the SMS to its e-mail address (indicate “FLW – organization name” in the subject line): migration@ssm.gov.kg.

2.10. One application (from one company) is sent in one letter. If applications from several companies are filed, it is necessary to send to the specified e-mail address an appropriate number of letters, each of which must contain a complete set of documents.

 

 

The procedure for signing the documents with EDS is provided in another instruction.

  1. Feedback with the Applicant

3.1. After sending documents electronically, a message containing a unique number confirming the delivery of electronic documents to the SMS system shall be sent to the Sender’s address. The unique number must be saved (written down, copied to a text editor, etc.).

3.2. When specifying the unique number mentioned in clause 3.1 hereof upon application, the Applicant can receive the information on tracking the electronic documents in the SMS system.

3.3. If the transport container does not meet the requirements of the format-logical control established by the SMS, a message containing the information on the detected non-compliance will be sent to the Applicant’s e-mail address. The transport container will not be sent for further processing.

3.4. Not later than the working day following the day when a complete set of electronic documents are received, the File (message) on the receipt of electronic documents will be sent to the Applicant’s e-mail address.

3.5. The notice of the decision on the results of consideration of documents will be sent to the Applicant’s e-mail address
