HISTORY

The State Migration Service under the Government of the Kyrgyz Republic is an independent body that implements the state policy in the migration sphere, ensures compliance with the migration legislation of the Kyrgyz Republic and renders public services in the migration sphere. The service is subordinate to the Government of the Kyrgyz Republic.

In order to implement the Resolution of the Jogorku Kenesh of the Kyrgyz Republic “On the Compliance with Articles 10 and 17 of the Constitutional Law of the Kyrgyz Republic “On the Government of the Kyrgyz Republic”, the Ministry of Labor, Migration and Youth was reorganized, and upon Resolution of the Government of the Kyrgyz Republic No. 854 as of December 11, 2015 “On the Issues of the State Migration Service under the Government of the Kyrgyz Republic”, the State Migration Service under the Government of the Kyrgyz Republic was established.

The Service performs the following functions:

1) functions of sectoral policy:

– implements the main directions and priorities of the state policy in the migration sphere;

– develops and submits to the Government of the Kyrgyz Republic drafts of regulatory legal acts regulating the issues of state policy in the migration sphere in accordance with the established procedure;

– in accordance with the established procedure, submits to the Government of the Kyrgyz Republic proposals on the formation of the annually established quota for the attraction and use of foreign labor in the territory of the Kyrgyz Republic and the distribution (redistribution) of quotas for the attraction and use of foreign labor in regions and sectors of economy in accordance with their needs;

– analyzes, forecasts, monitors and evaluates migration processes in the Kyrgyz Republic;

– ensures the implementation of state programs to assist immigrants – ethnic Kyrgyz and kairylmans;

– conducts registration of applications for recognition as a refugee in the Kyrgyz Republic and takes decisions on granting a refugee status as established by the legislation of the Kyrgyz Republic and the international agreements to which the Kyrgyz Republic is a party, entered into force as established by legislation;

– conducts registration of applications for recognition as a kairylman in the Kyrgyz Republic and takes decisions on granting a kairylman status as established by the legislation of the Kyrgyz Republic;

– ensures the implementation of the state policy on socio-economic adaptation of immigrants – ethnic Kyrgyz and kairylmans;

– considers the applications of individuals and legal entities for issuing a permit to attract and use foreign labor in the territory of the Kyrgyz Republic, to engage in activities in the sphere of employment of citizens of the Kyrgyz Republic abroad;

– takes decisions on granting a status of an immigrant in the Kyrgyz Republic as established by the legislation of the Kyrgyz Republic;

– holds activities on legal propaganda in the supervised sector;

– keeps records of asylum seekers and refugees, kairylmans and foreign citizens who have a permit to work in the Kyrgyz Republic;

2) coordination and monitoring functions:

– in accordance with the established procedure, conducts consultations, negotiations, concludes international treaties and organizes interaction with relevant authorized bodies of foreign states, international and public organizations on the issues within the competence of the Service;

– monitors international treaties, national and state programs aimed at supporting citizens of the Kyrgyz Republic working abroad, kairylmans, as well as in the sphere of ​​preventing human trafficking and the stay of foreign citizens for the purpose of working in the Kyrgyz Republic;

– interacts with interested ministries, state committees, administrative departments, local state administrations and local self-government bodies in dealing with migration issues;

– ensures the development and coordination of activities for the introduction of migration cards;

– takes part in keeping records of refugees, asylum seekers, immigrants – ethnic Kyrgyz, kairylmans and foreign citizens who have a permit to work in the Kyrgyz Republic;

– forms information data banks on the issues within the competence of the Service;

– implements the state order for conducting scientific research and developments in the sphere of its activity;

– carries out information and explanatory activities on the implementation of state policy in the migration sphere;

– in accordance with the established procedure, organizes and holds international, republican, regional and local events related to the development of state policy in the migration sphere;

3) functions of rendering services:

– assists the citizens of the Kyrgyz Republic in finding employment abroad in the framework of state programs, intergovernmental and other official agreements;

– issues certificates of receipt of an application for asylum and refugee certificates;

– issues kairylman certificates;

– issues permit documents as established by the legislation of the Kyrgyz Republic;

– assists in providing ethnic Kyrgyz and kairylmans with state guarantees provided for by the legislation of the Kyrgyz Republic;

– considers complaints and applications of individuals and legal entities on migration issues in accordance with the established procedure;

4) functions of support:

– assists state bodies, local self-government bodies in the implementation of the state policy in the migration sphere;

– communicates with diasporas and national-cultural associations of compatriots abroad;

– assists in the organization of professional training and retraining of persons traveling abroad for the purpose of employment;

– works with interested governmental and non-profit organizations of the Kyrgyz Republic, as well as with international organizations and their offices, to develop a network of social support centers for victims of human trafficking and temporary accommodation of refugees and asylum seekers.
